CHAPTER III

Transfer of property as between seller and buyer

  1. Goods must be ascertained.
  2. Property passes when intended to pass.
  3. Specific goods in a deliverable state.
  4. Specific goods to be put into a deliverable state.
  5. Specific goods in a deliverable state, when the seller has to do anything thereto in order to ascertain price.
  6. Sale of unascertained goods and appropriation. Delivery to carrier.
  7. Goods sent on approval or “on sale or return”.
  8. Reservation of right of disposal.
  9. Risk prima facie passes with property.

Transfer of title

  1. Sale by person not the owner.
  2. Sale by one of joint owners.
  3. Sale by person in possession under voidable contract.
  4. Seller or buyer in possession after sale.
