APPLICATION ON BEHALF OF THE APPLICANT SEEKING GRANT OF INTERIM BAIL

Most Respectfully Showeth:

  1. That the applicant has filed the main application for [regular / anticipatory] bail which is pending before this Hon’ble Court and is listed for hearing on ______ / today.
  2. That the applicant is in judicial custody since ______ / has reasonable apprehension of arrest in connection with the above-mentioned FIR.
  3. That the investigation is [complete / still ongoing]. The charge-sheet has [been filed / not yet been filed]. The applicant has clean antecedents and has deep roots in society.
  4. That the present application is being filed seeking interim bail for a limited period pending final disposal of the main bail application on the following amongst other grounds:

GROUNDS

A. That the applicant is suffering from serious medical condition, namely ______________ (attach medical documents / certificates). The medical facilities available in jail are inadequate for proper treatment / specialised care is required urgently.

B. That there is likely delay in the final hearing of the main bail application due to non-availability of the case diary / heavy board / other procedural reasons. Continued incarceration would cause irreparable harm to the personal liberty and reputation of the applicant protected under Article 21 of the Constitution of India.

C. That the applicant undertakes to abide by all conditions that this Hon’ble Court may impose and shall not abscond, tamper with evidence, or influence any witness.

D. That the applicant is the sole breadwinner / has dependent family members / is of advanced age / is a first-time offender and no useful purpose would be served by keeping the applicant in custody during the pendency of the main application.

E. That the law laid down by the Hon’ble Supreme Court in Lal Kamlendra Pratap Singh v. State of U.P. (2009) 4 SCC 437 and Sukhwant Singh v. State of Punjab (2009) 7 SCC 559 clearly recognises the inherent power of the Court to grant interim bail pending final disposal of the bail application.

F. That other grounds as may be urged at the time of hearing with the leave of this Hon’ble Court.

PRAYER

In view of the above facts and circumstances, it is most respectfully prayed that this Hon’ble Court may be pleased to:

a) Grant interim bail to the applicant for a period of ______ weeks / till the next date of hearing / till the final disposal of the main bail application on such terms and conditions as this Hon’ble Court may deem fit and proper;

b) Direct the release of the applicant on furnishing personal bond and surety of appropriate amount to the satisfaction of the concerned Court / Jail Authorities;
